In April 1981, rights to residence of people were defined as the basic rights by "Declaration of Human Rights to Residence" which was passed at Urban Housing Problem International Symposium in London. So, "Residents should have their own houses"; it is given the fair and unbiased expression to the society by improve the living conditions, raise the quality of living, set up survivability of houses and solve housing problem of the low-income and disadvantaged group. To solve the increasingly serious problem, the government has increased to implement the policy of housing security system. A concept named "affordable housing with common property" comes into existence. In 2007, the government tried the new mode firstly In Huai’an City of Jiangsu Province. After that, the new solution had been administered gradually by more and more local governments. In 2009, affordable housing method arose in Shanghai. Therefore, legal issues related to affordable housing with common property have progressively become a new phenomenon of law.It has been three decades that the first property management company was founded in 1981 in China. The companies were gaining experience of property management continuously. Although it had a late start, property management in China has formed a significant impact on our social life. The management meets the daily needs of community residents, and that plays an important role in beautify the community environment and maintain the society stability. For these reasons, we should acutely realize the key:law in property management of affordable housing.Many developed countries and regions (United Kingdom, Singapore, and Hong Kong) have established a mature legal system in property management. For instance, UK built an affordable housing residential community for 5700 persons in 1986; Singapore started a housing security program and assigned Housing Development Board to be in charge of property management; Hong Kong Housing Department is directly responsible for managing the houses for sell or rent to low-income families and these buildings are invested by Special Administrative Region.It is reported that Shanghai will build and raise security housing for 15 million square meters(22 million units), including affordable housing 5 million square meters (about 8 million units) in 2011.By 2012, Shanghai will begin to construct affordable housing for 20 million square meters, equivalent to 30 million units.This thesis focuses on Shanghai, with the basis of advanced experience in United Kingdom, Singapore and other countries, and researches the property management of affordable housing with common property, furthermore I want it could be a modest contribution to complete the legal system of this field.This paper is divided into five chapters, as follows.The first chapter is an introduction, and by summarizing the evolution of housing security system and the development process in property management of China and Shanghai, the author discusses the background and significance of legal issues related to the residential model.The second chapter analyzes the meanings, legal basis and characteristics of affordable housing. It describes the newly developed concepts of house ownership, common property and affordable housing in the chapter. And through analyzing the common property affordable housing policy in Shanghai, the author explores the nature, trait and property rights limit of these special houses.The third chapter, from the point of basic theories and legal relations of property management, elaborates the several aspects:property and property management, legislation of property management, subject and object of the legal relations, the relationship between condominium ownership and modern property management and so on.The fourth chapter deals with the development of affordable housing and property management in foreign developed countries and regions. The author compares domestic policy with overseas advanced system, such as "public housing" in Hong Kong, "Home Ownership" program in Singapore and "affordable housing" model in United Kingdom.Chapter V discusses the matters of the legal issues about affordable housing with common property and how to settle some questions. According to some tough problem brought up in forward parts of the paper, the author will make some conclusions and recommendations on three areas.
