In recent years, with the popularity of the Internet, e-commerce has gradually moved into people’s lives. Third-party payment as a new payment platform, along with the rapid development of China’s e-commerce developed, has become the mainstream of the field of B2C and C2C payment mode. The emergence of third-party payment platform to some extent alleviate the current bottleneck of e-commerce payments, promote the development of electronic commerce, but also for the new market order to build and regulate the development of the business has brought new issues. This start of the third-party payment industry to discuss regulatory issues, through third-party payment of legal relationship to sort out legal and regulatory issues of third-party payment to reflect the purpose of paying third-party to have a clearer understanding to promote China’s first payment of legal and regulatory framework of the tripartite construction.This thesis is divided into five parts:the first part overviews the third-party payment, mainly for third-party payment concept, characteristics and significance of the set, third-party payment platform, payment model and the Chinese comparative description of the status of third-party payment. The second part introduces the legislative status of Chinese third-party payment and an overview of the legal relationship the parties.In part three, the author analyses the limitations of China’s third-party paymentand the various risks in the transactions through the third-party payment. Part four focuses on certain countries with respect to the legal regulation of third-party payment systems and regulations, mainly the United States, European Union, Canada and Asian countries.In short, with the further development of e-commerce, third-party payment platform to strengthen financial regulation, payment of building a harmonious online environment is a priority. China’s third-party payment platform with the regulatory status quo, the first four parts of the discussion, based on Part V focuses on the establishment and improvement of Chinese third-party payment system, the idea of legal regulation, including a clear third-party payment agencies the legal nature of the subject, in the specification and development to choose, perfect regulations and policies, to strengthen supervision.
