Now is the Internet financial big data explosion era, with the rapid popularization of Internet banking in China, the consumption patterns are gradually changing. At the same time, the commercial bank online banking and electronic banking is an epitome of the rapid development of e-commerce, e-commerce relies on the basis of the integr ation of Internet technology on the platform of third party also obtained the fast devel opment. As a credit intermediary of the third party payment platform, the buyer’s right s are well protected, more and more people rely on third party payment network trans actions.In 2005, the rapid development of relying on Taobao Alipay, marking the third part y payment has been widely recognized. Third party payment not only act as a credit in termediary, but also bear the responsibility of payment gateway. A good solution to th e network transaction parties do not trust each other and bring a lack of appropriate pa yment problems. Needless to say, the third party payment greatly promotes the develo pment of electronic commerce, to a certain extent of China’s payment and settlement s ystem at that time. But the third party payment also affect China’s financial system an d monetary market credit system, which funds precipitation problems, money launderi ng, unfair competition network problems, the threat of China’s financial market order policy. Although the country has issued a series of laws and regulations to standardize its development, and have achieved certain results, but the third party payment indust ry is still in a blank area in the part of the business of legal supervision. Starting from the current third party payment problems, and build a more complete Internet financia 1 legal supervision system of the third party payment system analysis, in order to serve the healthy development of Internet banking.The first chapter is the introduction, an overview of the research purpose and sig nificance, review of research status and significance, the paper structure, briefly point s out the ideas and innovation; the second chapter is the present situation and develop ment trend of the third party payment, this chapter through large amounts of data and analysis of the current situation of the development of the icon of our third partypaym ent, to our current status of the third party payment market situation and development trend of the third party payment, points out that the healthy development of the third p arty payment needs a good economic environment and legal environment, leads to Ch ina’s third party payment market problems. The third chapter is our country third party payment market problems, points out the risks and financial security problem of third party payment market network, credit card cash money laundering, unfair competitio n, the precipitation of funds, and to enrich the case evidence; the fourth chapter of the third party payment supervision system at home and abroad are compared, the the cha pter is divided into two parts, the first part of the first from the legislative level, super vision mechanism, fund management and other aspects of precipitation, the EU USA t hird party payment legal supervision system to carry on the analysis, summary of exp erience. The second part reviews the Internet Financial third party payment in our cou ntry legal supervision system, analysis shows that there are legal provisions, the law e ffect level is not high, the content is not comprehensive legal responsibility for such is sues is not clear, the existing legal supervision system is not perfect; the fifth chapter i s the perfection of China’s, third party payment-regulation measures;this chapter from three aspects of the regulatory philosophy, regulatory body, regulatory system of our c ountry third party payment regulation puts forward corresponding suggestions. This m echanism should establish collaborative government supervision, administrative super vision, industry supervision, public supervision to ensure the healthy development of t he third party payment.
