Since the housing distribution monetization reform, China’s real estate industrydeveloped rapidly. Real estate industry has been become a pillar industry of ournational economy in2003.In the process of development of the real estate industry,the high house prices rise, appear too fast, the market operation is not standard, thecontradiction between supply and demand, and a series of the contradictions andproblems to be solved.In order to promote the healthy and stable development of thereal estate market, the government also unceasingly promulgates policy to control ofthe real estate market. After a series of policy regulation and control,the fundamentalproblems still have not been resolved. The real estate market order still chaos. Houseprices are still in the higher. the government on real estate regulation and control hasbeen insufficient. So, the paper recounts the related theory, arguments are under thesystem of socialist market economy. China’s real estate market based on marketregulation, giving full play to the market economic price, the supply and demand, thecompetition mechanism role. The real estate market has a market failure.Therefore, inthe real estate market, the government’s macro intervention and regulation becomeinevitable. Our government’s control process and result has been proved by PublicChoice and related theory.This paper collects a large number of empirical data andanalyses the status quo of China’s real estate market regulation and control.Combining with Germany, the United States, Japan three country’s regulation andcontrol experience, analyses the causes of deficiency of real estate regulation. Thestudy analyses the reason of insufficient regulation and control of China’s real estateand put forward the corresponding countermeasures and suggestions.The study is divided into five parts, the main contents is as follows:The first part is discussing, collecting and analyzing the related theory.Theresearch support is the theoretical analysis, according to market economy, marketregulation, market failure, government intervention and government failure theoreticallogic.The second part parses the regulation countermeasures of the real estate inGermany, the United States and Japan. This provides an important reference forChina’s real estate regulation and control.The third part in time sequence collect, sort out our government regulation andcontrol for the real estate on the introduction of the nearly a series of policy, and sumsup the core content of each policy. By using the detailed data analysis theeffectiveness of regulation and control, reaction real estate regulation have beenachieved.The real estate market regulation and control, on the other hand, there arestill many problems with lack of control effectiveness, such as the high home prices,the indemnificatory housing construction is lagging behind, the order of real estatemarket chaos, etc.The fourth part analyses the main reason for the unconspicuous effectivenessof the real estate market regulation and control, including market factors, thegovernment factors and other factors.The fifth part puts forward the countermeasures and suggestions of the real estate regulation and control. Improving the real estate market mechanisms, clearing duty ofthe government, rationalizing the relationship between government and the market,establishing an effective monitoring mechanism to prevent the government"economic man" behavior, giving full play to the role of local government regulationand control of real estate, raising the level of government decision-making, makingthe real estate industry long term development plan, setting up and perfect the housingguarantee system, improving the housing finance system, sound real estate taxmechanism, strengthening the supervision of the real estate market.
