Construction project claims in China,beginning from the project of Lu buge pilot at1980’s inYunnan Province,has been gradually emerging in the vision of the construction managers. Afternearly20years of development, the domestic construction claim supervisory word has obtained theconsiderable development,and also obtained varieties of successful case. Especially in the early21stcentury, China in claims management research has made significant progress, it is not only onqualitative analysis or quantitative analysis, it also based on the opportunity to claim, research onmethods of claims, there based on organization theory, risk factors analysis, and the enployer’sclaims. For one word, all of these research is full range of multi-angle studies. but most of themfocused on the methodological aspects of the claim, but few focused on the system itself of theclaims.This paper introduces a new management theories-synergetics, using its basic concept to madein-depth analysis on how to improve the mechanism for claims. In this paper, the auther startanalysis with the order parameter of the claim system (including the risk factor, the role of owners,project managers, etc.), and then study the self-organizing process, that is, when instability eventoccurs, the whole system how to reach a new steady-state throught their coordination between thevarious subsystems. On this basis, the paper focus on the most important order parameter-theconstruction contract risk allocation mechanisms, and the contract dispute resolution mechanism,which is most important factor that improve the claims system to new steady state. The authorsupposes that a perfect claims mechanism not only requires a unified, clear responsibility andauthority of the contract target system, not only requires to proactively identify opportunities toclaim, but it also needs reasonable allocation of risk based on a comprehensive risk attitude. Thereshould introduce the commonly used in international construction contract dispute resolutionmethods, such as DRB/DAB mechanisms,combined with China’s national conditions, to ourdemonstration project contract text. Finally, the article suggest that "win-win, coordination" insynergetics theory should connected with the Chinese traditional concept of "harmony",andimplement the project claims management practice.
