Research On Construction Claim Prevention And Management Occurring To One Of Shanghai Themed Parks

With globalization,Chinese contractors will have more and more opportunities to contract overseas construction projects and more and more foreign investors will invest or perform construction projects in China,construction claim management as one of normal practices in international construction industry has been gradually recognized and accepted by Chinese contractors.The hands-on experience of global contractors has proofed that construction claim management is one of essential businesses for international construction project management and it is also one of critical processes to determine how much profit contractors will obtain from the projects.Construction claim management is the concrete manifestation and core task of project management of international construction projects.With rapid development of Chinese economy,Chinese people are seeking for spiritual enjoyment besides hunting for creature comforts,the variety of themed parks have sprung up all over China.However,most of large scale themed parks followed their specific standards or codes to build projects rather than general written standards or codes,one of Shanghai themed parks with creative and artistic facilities that are located in Chuansha,Pudong District in particular.This situation definitely makes construction of themed parks more difficult,brings more uncertainties to the project,increased more potential claim elements in the course of construction project lifecycle and new challenges of construction claim management for the Employer and the Contractor.The dissertation researched and studied construction claim management of one of Shanghai themed parks from the standpoint of the Employer.Firstly,it introduced the background and significance of its research and study,studied construction theory and comprehensively described of construction claims,which have paved the way for studying construction claim prevention and management.Secondly,it analyzed the elements of construction claim related to one of Shanghai themed parks.Thirdly,identified and analyzed the potential claim elements might exist at each phase of construction project lifecycle.Fourthly,it analyzed and studied some cases of construction claims happened on one of Shanghai themed parks.Finally,it drew a conclusion and looked ahead for future research and study.The author of this dissertation hoped to offer references for contractors who will contract and build large scale themed parks or the feature of the construction projects are similar to themed park.In addition,she also expected to help construction contractors to raise construction claims from objective,reasonable and legal standpoint and to improve construction claim management of contractors.
