Research On The Protection Of Geogaphical Indications Of Agricultural Products In Shandong Province

Geographical indications of agricultural products are an important part of the field of Intellectual Property Rights, and get more and more attention all over the world. The development, application, use and protection of the geographical indications of agricultural products are the inevitable result of the development of modern agriculture trend to characteristic, scale, and the regional cluster. Establishing the geographical indication protection system and improving the geographical indication protection mechanism of agricultural products are the important means to realize the development of the agricultural regional economic, to improve the rural industry structure, to increase the farmers’income, and to establish the agricultural products brand.Basis the accessing analysis of the literatures at home and abroad, this paper use study from the current status of the resources of geographical indication of agricultural products, the definition of the protection subject, the game analysis and the decision-making of producers through the binary logistic regression and game analysis. It is aim to discuses the protection of geographical indications of agricultural products in Shandong.Shandong as a big agricultural province has the rich resources of geographical indication of agricultural products, so it has the advantages of the basic conditions to implement the geographical indication protection system. But, as to the development, application, the market competitiveness, there is still a large gap between Shandong and the developed countries in Europe and the United States at present. At the same time, the producers know a little of the geographical indication protection system, this also brings some difficulty to the development of geographical indication industry.The current situation of the resources for geographical indication of agricultural productions is the starting point in Shandong province. This paper analyzes the implement of the geographical indication protection from the basic conditions, the protection status and the economic effect. To realize that there are still five problems in implement of the geographical indication protection, they are protection and management subject chaos, low utilization rate of geographical indication, fake phenomenon of agricultural products, business scale scattered. And provide the basis for the followings.The analysis-of the influence factors of decision-making to apply for the use of geographical indication of agricultural productions-is the center of the research. This paper follows "the rules for geographical indication of productions" and the process of application and use, and defines the protection subject as the applicant of geographical indication of agricultural productions, the user of geographical indication of agricultural productions, the supervisor of geographical indication of agricultural productions and the consumer of geographical indication of agricultural productions. The paper also analyzes the protection subjects using the game analysis.The research of conclusions and suggestions is the ending of this paper. Basis of the hole paper, this paper provides some suggestions from increasing the geographical indication protection system, regulating the propaganda of process of geographical indication production and increasing the support strength for the geographic industry, sounding the supervising and checking mechanism for the geographical indication productions, the administrative department and geographic indication producers should get together to stroke counterfeit false and inferior, enhancing the frequency of the supervision and the fines, and establishing the information disclosure system and product inquires platform for geographical indication protection.
