Research On Mechanisms Of Chaina’s Land Administraeion Ethics

Land is important means of production in the process of production and life of human, Land administration is the action that Government organizes and manages the possession, the use and the transfer of land, which could coordinate the relationship between supply and demand of land and ensure the rational use of it. The realization of land administration functions needs not only constantly improve and perfect the related legal systems, also give full play to the constraints of ethics. Therefore, the need for study of land administration ethics becomes more and more important. Traditional moral theories stress on achieving the goal of perfection through individuals’moral self-discipline, this theory has some limitations because it emphasizes the importance of individuals’intrinsic cultivation but neglects the building of ethical systems, thus ignoring the important role of ethics mechanisms.Mechanisms of land administration ethics are relationships between various elements of administrative ethics and its external environment, and it is a specific way that land administrative ethics play its roles. Relationships of land administration ethics, systems and organizations of land administration ethics, and principles and norms of land administration ethics are the basic elements of land administration ethics which demonstrate some level characteristics. Among them, relationships of land administration ethics are in the core layer, systems and organizations of land administration ethics are in the middle layer, and principles and norms of land administration ethics are in the behavior layer. The interaction between them constitutes the main chains of operating mechanisms of land administration ethics, which also determines functions of it. Harmonious relations between people and land, Just systems of land administration, and moral self-discipline of land administrators make up the objective system of operating mechanisms land administrative ethics, and the reason of ethical anomie and contradiction between people and land in the process of land administration is that there are some problems with operating mechanisms of land administration ethics. Development mechanisms, selection mechanisms, evaluation mechanisms and supervision mechanisms are important parts of operating mechanisms of land administration ethics. It is important to the construction of operating mechanisms of land administration ethics that analyze deeply and explore practically the problems of these mechanisms and propose some measures for improvement.Lastly, we use abstract-concrete method and structure-function method to study the basic rules and the chief problems of operating mechanisms of land administration ethics in the perspective of its major chains, striving to make reasonable explanation and demonstration for the operation and perfection of land administrative ethics.
