Justice and efficiency are the important issues for the China’s development. Since the reform and opening up, the process of urbanization has become faster and faster, while the urban area is expanding. By expropriating land and housing demolition, our government gets collective land from farmers. Because of lack of the professional planning in our rural area, the collective construction land has been in inefficient, which is a very wastage while the land resource is scarce in today’s society. The value of the collective construction land is not high, in the other words, because of the defects of the property right, the conversion process of the land collective construction land is limited, and the appreciation capacity is weak. In this case, the land resource allocation is not efficient, lending to the inefficient using of the collective construction land in a long period.This paper describes the defects statue of the property right of the collective construction land, and analysis the two reasons intensively: the omission of property right, the plunder from the outside and the law restriction (the discrimination of the property right). Based on the qualitative analysis of the reasons of the influence of the defects of the property right, it estimates the price of the rural collective construction land on the invisible market with the residual method (land of minor-property-right house as an example). It estimates the national investment ratio of the impact of land prices by regression analysis. By comparing the price of the State-owned land on the open market and the price of the rural collective construction land on the invisible market, finally we can get the amount of the collective construction land’s price decrease because of the defects of the property right. The omission of the property right will increase the fees, and the discrimination of the property right will increase the risk. These will increase the price of the collective construction land. But actually in the situation, with a lot of restrictions, the farmers constantly find a way out to reduce their income from property cases, and then to achieve maximum benefits. the collective construction conversion price will raise, but because of the limit. On the surface, the farmers will receive more benefit than housing demolition; actually it leads to lose of the resource of the whole society. Finally this paper uses three ways--property right reform, benefit distribution, and price mechanism—to solve the problem because of the defects of the property right.By investigating the influence of the defects of the property right to the collective construction land, under just and equal society background, endow the farmer with the equal property right, and protect farmer’s interest. In the one hand, under the impulse of interest, it can accelerates the reform of the land property right, and establish a uniform land market, and then enliven the rural land to solve the intense conflict of people and land. On the other hand, it can provide some evidence to the revolution of the housing demolition in china’s rural area, letting the farmers enjoy the benefit of the property right possessor.
