Since the reform and opening up,China has increased the emphasis on the marinefishery resources year by year.The proportion about the output value of marinefisheries resources in total agricultural output value has beening improving gradually.However, with the vicious competitive caught, the severe recession of ocean fisheryhas showing, more serious is some harvested species are disappearing.Thedeterioration of the marine environment has exacerbated the depletion rate of marinefish. The extensive development of marine fisheries resources result in the “tragedy ofthe commons” frequently in the fishing zone.To protect the marine fishery resources,China has issued a series of policies and regulations, such as "dual control" system,the system of fishing moratorium and the fishing license system in some parts, but thefact is that these regulations and policies have not effectively suppressed the recessionprocess of the fishery resources. That the unclear property rights of marine fisheryresources created a large number of free-riding behavior and opportunists.So, in orderto fundamentally solve the problem of marine fishery resources, the beginning is thesystem of property rights,from which to explore the true property rights system offishery resources whose goal is the long-term intrests maximizing.In view of this, this paper comes up with the concept about collective propertyrights system of the marine fishery resources.When the costs and benefits can not beinternal, public decision-making is needed. For marine fisheries resources,theircharacteristics about sharing, liquidity, diversity and other natural and economic traitsattribute a problem that is “who is fishing, who took possession”,without a clear wealthof possession relationship. The weaken independent property rights makes the right ofthe fishery resources neither simply taking private,nor generally taking public,whichwill affect the sustainable use of resources. Confront to the problem about the viciouscompetition of public resources from the fishermen and the high cost of direct supervision by thegovernment,that needs a rational agent who is supervised by the government to supervision the fishermen,and make the rational strategies for sustainable development of fishery resources in thecollective property rights strategy.In accordance with ask questions-analysis–solutions,after in-depth analysis ofthe root causes of the problems of marine fisheries resources, based on the mode ofcollective property rights analysis about the implementation of the agency relationshipgame, this paper reach the feasibility of the collective property rights in themanagement of marine fisheries resources, and gives the relevant recommendationsfor the implementation of collective property rights system.
