Study On Technical Model And Promotion Measures Of Affirmation In Rural Land Contract Management Right In Shanxi Province

Ruralbasic management systems of China is a bilayer management system combiningunified withseparate that is based on household contract management. As a basic economicsystem, rural land system is the basis of the relations of production in rural areas. It is of greatsignificance for the increase of farmers’ income and rural development. The No1centraldocument in1982and1983has confirmed the land contracting right of farmer. In2002, theofficial declared that the country implement rural land contractual management systemthrough the Rural Land Contract Law of the People’s Republic of China. At this point,farmers’ land contract rights had been officially finalized in a legal form. According to thelegal provisions and requirements, the affirmation in rural land contract management rightmean that the farmers’ land contract and management rights are registered in the form of thetext of the law and the certificates, to further consolidate and improve the rural land contractrelations, to give farmers more secure property rights. Study on affirmation model in ruralland contract management right is a pioneering work. There are no mature replicable modelsfor reference in Shanxi Province currently. We can propose a suitable affirmation model forfarmers’ land contract rights in Shanxi Province after study on three affirmation models inxinjiang Shanxi, gaoling Shaanxi, and the Anxian Sichuan through Field research, discussionseminars, literature review, and so on. And we compared economic of land ownership modethat we studied in this researchwith local land ownership mode in Pu county, Changzhicounty and Xinjiangcounty in Shanxiprovince. This can provide data support foreconomically viable of landownership mode in Shanxiprovince. After study on affirmationin rural land in Shanxi Province, we can find some questions such as size area controversialin policy level, registration of the right of land contract and management rights, workingmethods in affirmation, safeguard measures and the low level of Information management inland contract. Next, we analyze historical factors, technical factors, policy factors andunderstanding factors, respectively. At last, six advancing measures are purposed. First,Accurately grasping the policy limits and properly solving the difficult problems of landownership; second, strengthening the leadership, guiding farmers to actively participate in and forming a joint force in the various departments; third, Actively seeking financial supportat all levels to ensure the budget and implementation; fourth, actively promoting the landcontract and information management; fifth, actively training the registration to improve thequality of affirming staffs; sixth, strengthening the sense of security and confidentiality anddoing good job in registration confidentiality. I hope that the proposed rural land contract andmanagement rights in this study are indeed the right mode to provide guidance and referencefor the comprehensive work. It can play a certain positive role in strengthening the landcontract and management rights of farmers.
