The Mechanism Of Protecting And Coordinating Farmers’ Rights Among Rural Land Transfer

Land is the most basic production material in agricultural development, and alsois the most basic life guarantee for farmers. Rural land transfer is an effective way toenhance proper allocation and use efficiency of the rural land, and this is also the onlyroad to build new socialist countryside and develop modern agriculture in China.Establishing standard mechanism of interest coordination in farmland transfer playsan active role in enhancing farmer’s enthusiasm for land transfer and proper allocationof land resources. It was nearly a decade since the first document of CPC CentralCommittee allowed the land transfer in1984. The scale of land transfer is not largefrom a nationwide perspective. Currently, there are many forms and ways of ruralland transfer. With the deepening of rural land transfer, the pace of rural land transferis getting faster. While, due to the reason of rural land system, the government and thefarmers themselves, and many other reasons, In the process of land transfer, theproblems of farmers’right being infringed are increasingly serious, which mainlyrepresent as farmers’right and interest being infringed by unclear land property rightand non-standard operation, phenomenon of government scrambling for benefit withfarmers: unreasonable land transfer rental criteria, low compensation level. Ittriggers farmers’ appeal to high authorities for help due to the lack of right guaranteein the process of land transfer and hardship of employment of farmers’ who lose land.There are more and more conflicts between farmers’ and government, as well asrelated units. The nature is more and more serious. Farmers’ right guarantee, whichinvolved, is not only a significant economic matter, but also a serious political onewhich already became the main factor affecting countryside’s social harmony. Thesetense relations have become immense hidden danger of undermining social stability,affecting construction of socialist harmony society. Nationwide scholars all makeresearch on land transfer,including the form of land transfer, existingproblems,problems of forms of land transfer,system background and functionsetc.,which play important part in promoting land transfer and urban-rural balancedevelopment.The article firstly describes the concept and characteristic of rural land transfer, as well as implementation of interest coordination mechanism in all formsfrom a theoretical point of view. It takes Mazhan town of Cangnan county as anexample,starts with different patterns of rural land transfer.draws out problems suchas non-standard of interest relation and finally leads to advices on guaranteeingfarmers’interest mechanism to provide basis and references for building Cangnanuniform urban-rural land market and promoting land policies joined in macro-control.It also proposes policies and suggestions on boosting proper operation of Cangnanrural land market.
