Study On The Legal Countermeasures Of China In Coping With Climate Change

With the development of world economy and high energy consumption, climate change is becoming increasingly serious, and had a profound impact to human life and economic, the international community in all countries attach great importance to the response to climate change, This article mainly elaborate the improvement of the legal measures to address climate change, the paper is divided into five parts.The first part introduces the concept of climate change and its causes and the effects on humans. First, explains the definition of climate change, Then it indicates that the climate change is due to human activity causes, and finally illustrates the impact of climate change on human, introduces an extremely adverse impact and threat of climate change to human, climate change has had a profound impact to the natural ecosystem, which affects the human living environment, and indirect effects to the human economy and life, so the response to climate change is very tight.The second part mainly introduces the international law to deal with climate change.This section introduces the 《United Nations Framework Convention on Climate Change》 and the《Kyoto Protocol》 and the achievements after 《Kyoto Protocol》.《United Nations Climate Change Framework Convention on Climate Change》 is a specialized legal documents of the international community to address climate change, and has made a new attempt in international response to climate change.《Kyoto Protocol》 is a binding legal environment protection files set by the international community, epoch-making significance in addressing climate change. Then presented the Conference of the Parties held and the achievements after《Kyoto Protocol》The third part describes the legal measures taken by developed countries and areaes like the United States, Japan, the EU in combating climate change and countermeasures.Researches on these countermeasures bring advanced technology and experience for our response to climate change.Then elaborated foreign measures to address climate change has brought us the enlightenment.The fourth part introduces the current situation and problems in our response to climate change.First described the positive position of our response to climate change under the new situation, and then introduced China’s current legal framework to address climate change, Finally Illustrated the problems in China to address climate change laws, mainly macro-legal system and micro legal mechanisms.The fifth part mainly introduces the improvement of the Legal Countermeasures in China in response to climate change.It first explains a guiding ideology and the three basic principles to improve aclimate change law countermeasure, and then from the macro and micro aspects specifically addressed the legal measures to improve the response to climate change, to put forward my own proposals.
