The earth’s ecosystems providematerial support for the economic development and people’s daily life, is the material base ofthe sustainable development of society. But long affected by invaluable resources concept, theresources are not reasonable exploitation and abuse has seriously affected the regenerationcapacity of ecological system of their own, to repair the damaged environment to restore theecological function and value is to achieve the requirements of sustainable development, bythe beneficiary interests loss of ecological construction in the ’compensation in accordancewith the principles of fairness and justice. Ecological compensation is since the nineteenfifties, some countries and regions in order to cope with the economic and social developmentof the resource depletion and ecological damage problems try a means to solve the, play anactive and important role in tension between the balance and coordination of economic andsocial development and ecological protection. At present, the scholars in different domains ofdifferent perspectives of ecological compensation, but the study on ecological compensationat home and abroad is still in the early stage, has not formed the unified theory. Ecologicalcompensation is an important means of ecological maintenance and construction. Ecologicalcompensation has become a hot issue in science and sustainable development research in thefield of ecology, environmental economics, environmental management. Ecologicalcompensation legal system is a rule system composed of a series of laws and regulations ofecological compensation relations, constructing ecological compensation legal system in ourcountry is one of the current establishment environment friendly harmonious social order task,research on ecological compensation legal system is an important part of the study ofenvironmental law. In China’s ecological environment is becoming more and more serioussituation, research on ecological compensation from the perspective of environmental legalsystem, has the positive significance of sustainable development will be to protect theecological environment and social. Based on this, this paper discussed the ecological compensation legal system general theory and the establishment of ecological compensationlegal system in the background, necessity and possibility of ecological compensation legalsystem and suggestion.
