Regional Ecological Compensation Legal System Research

In the early years of China’s reform and opening up,China proposed the development idea of’efficiency first, fairness considered’, to meet the basic requirements of social development at that time. Regional development strategy led to the high speed development of economy in our country. In recent years,development level of different areas of China have produced serious ecological problems,the problems restricted the economic and social development in China seriously. Ecological benefit output region and ecological benefit between the economic development imbalance, led to the increasing development gap. Sacrifice part of the region’s ecological environment lead to another part of the region’s economic development is’efficiency’, but to a certain extent is lack of a’fair’. Until today, ecological benefit output with no capacity or the subjective intention of the ecological environment improvement, lead to the emergence of weak ecological construction. Even parts of seeking for the development of the economy, is built on to destroy the ecological environment, reduce the basis of ecological benefits. In the end, the ecological benefit output problem also affects the ecological benefit of ecological environment and sustainable and healthy development. Along with our country economy high speed development, in order to deal with the new situation, the party in16big established a set of people-oriented, comprehensive, coordinated and sustainable scientific development’, the scientific outlook on development put forward the’efficiency’and’fair’in a strong thought. The regional ecological compensation as an important means of macroeconomic regulation and control, not only strong’efficiency’but also’fair’, and coordinate the development of China’s regions.In this paper, on the basis of the theory of ecological compensation, through to the view of development priority zones of ecological compensation and analysis of regional ecological compensation issue. And on the main body of ecological compensation, concrete system design and the legal system is studied. Regional ecological compensation is to promote the ecological benefit and economic interests relationship between steady development effective means, to narrow the gap between regions, strengthening the regional cooperation, promote regional harmonious development, promote the development of the western and eastern increase efficiency is of great significance.
