A Study Of Legal Issues Of The Automobile Exhaust Pollution Control Of China

The widespread use of motor vehicles is one of the main symbols of moderneconomic prosperity, and is also the testimony to the development and progress ofsocial civilization. Yet people enjoy the convenience and benefits that the motorvehicles have brought, they also endure the increased amount of pollutants frommotor vehicles’ exhaust emission, which include carbon monoxide, nitrogen oxidesand volatile organic compounds, fine particles and lead. It not only causes the seriousair pollution in our country, but also brings great potential dangers to people’s health.With the rapid economic development, the pollution of motor vehicles’ emission hasbecome one of the fastest growing urban pollution sources in China. The control ofmotor vehicles’ exhaust pollution becomes an important problem in our country thatneeds to solve. Therefore, the management of motor vehicles’ exhaust pollution is thekey to controlling air pollution in China. And the study about the motor vehicles’exhaust pollution control also becomes a hot issue of present academic discussion.The study of the motor vehicles’ exhaust pollution control began in the mid1980s. At present, correlation studies mainly focus on how to solve this problem, andthe study and discussion of scholars domestic and overseas have got many helpfulresults. However most of the study and discussion are made from the perspective ofenvironmental engineering design, the application of car environmental technologyand so on, and others aim at introducing the systematic control of motor vehicles’exhaust pollution in foreign countries, such as A Comparative Study on Sino-USLegal Control of Motor Vehicles’ Exhaust Pollution and Status and Trends ofAuto-fuel Quality in EU etc. However, this thesis is to discuss the construction oflegal system of motor vehicles’ exhaust pollution control, and make recommendationsfor the legislation of it in China. Based on the study and analysis of current legislativestatus of motor vehicles’ pollution control in our country, and based on the lessonslearned from foreign experiences and relevant legislation, this thesis proposessuggestions for the basic principles, rules and corresponding legal liability of thelegislation for motor vehicles’ pollution control in China. This thesis also systematically testifies the construction of motor vehicles’ pollution control systemand its legislative principles by using the method of comparative analysis and themethod of combining investigation and value analysis.The reason why motor vehicles’ exhaust pollution is spreading in China is that:the lack of relevant legislation to regulate the motor vehicles’ pollution control, thelack of legal norms which causes ambiguous duties at management levels, disorderedmanagement system, imperfect control system and unknown subject of legalresponsibility for the contamination. Therefore, in order to change China’s currentsituation of motor vehicles’ exhaust pollution as soon as possible, we must considerthe reality of economic and social development. As to the main problems in thevehicle management system, we should draw useful experiences from foreign motorvehicles’ exhaust pollution, so as to scientifically construct a legislation system of themotor vehicles’ exhaust pollution control, make management system in order, clarifyroles and responsibilities, and gradually form the legal framework whose core isAtmospheric Pollution Prevention Act, with relevant law and regulationsscientifically supporting it. Thus we can effectively contain and control motorvehicles’ exhaust pollution. Let’s strive for the improvement of the air quality inChina and give the public a clean living environment.
