| According to China's Ministry of Environmental Protection released the "China Motor Vehicle Pollution Control Annual Report(2015)" shows that China has become the world's motor vehicles sales for four consecutive years superpower, motor vehicle exhaust pollution has become an important source of air pollution, but motor vehicle exhaust pollution prevention and control, China is still faced with many problems. Therefore, this article will be China's current legal system of a motor vehicle exhaust pollution control analysis, summed up the present stage exhaust system of a motor vehicle pollution control legal problems and propose targeted legal countermeasures. This paper is divided into three parts, the main contents are:The first part is to define the status of vehicle exhaust pollution legislation and conceptual analysis, in this part of the article the concept of vehicle exhaust pollution has been clearly defined and introduced the motor vehicle exhaust pollution to the environment and human health to bring negative influence, the importance of prevention and control of vehicle exhaust pollution. It also reviews the current legislation of motor vehicle exhaust pollution prevention and control, and analysis of vehicle exhaust pollution control problems in existing legislation.The second part is the legal system of a motor vehicle exhaust pollution control the problems discussed. In this paper, the process of motor vehicle exhaust pollution generated by a logic line on China's legal system of a motor vehicle exhaust pollution control existing problems were discussed. First of all, motor vehicle fuel is caused by vehicle exhaust pollution source. This article will be divided into a motor vehicle fuel do not meet national quality standards for vehicle fuel, and vehicles meet national quality standards with fuel. It demonstrates the quality does not meet the national standard vehicle fuel greatly increased our vehicle exhaust pollution; and meet national quality standards for vehicle fuel due to our vehicle fuel quality standards can not play a push behind motor vehicle exhaust pollution prevention role. Secondly, the state allows vehicle emission limits for pollutants and related pollutants which are determined by the vehicle emission standards. Therefore, this article will be divided into a new vehicle production of motor vehicles, motor vehicles in use on our current vehicle emission standards were analyzed, considered with reference to the production of the new vehicle emission standards developed by European standards it is not suitable for a vast territory and the need to constantly add Yan of China motor vehicle exhaust pollution prevention and control; and with vehicle emission standards due to lax limits can not adapt to the new production plus stringent emission standards for motor vehicles. Finally, the paper discusses the vehicle emissions testing system, which is the prevention of motor vehicle exhaust pollution last ring. This paper analyzes the main part of the new car showroom and problems with motor vehicle inspection and maintenance system exists.The third part is to improve motor vehicle exhaust pollution control Legal Countermeasures. Based on the analysis of the second part of the argument, in order to improve motor vehicle exhaust pollution prevention and control of proposed legal countermeasures. Firstly, that the legislation should be from the enhanced operability, improve specialized in legal and other aspects of accountability mechanisms to improve vehicle exhaust pollution control legal system. Second, China should learn from extraterritorial "car oil" integration of ideas, through the enforcement of motor vehicle fuels and hazardous substances control standards to enhance the coordination of vehicle fuel quality and vehicle emission standards and other methods to improve the standard of motor vehicle fuel system. Moreover, by reference to European and US vehicle emission standards in favorable factors, to develop in line with China's national conditions of the motor vehicle emission standards. Finally, under the premise of combining the relevant provisions of the new "Air Pollution Prevention Law", we propose to the Ministry of Environmental Protection and other multi-sectoral joint cooperation ideas, new car announcement through enhanced binding detection methods to upgrade other ways to improve vehicle emissions testing system. |
