Research On The Responsibility Of Government In Environmental Protection

With the development of human society, especially after the industrialrevoluti-on, in the long process of development, compared with nature’sendurance, theuse of natural and transformation of human have been far more than the natural abilityto bear. With the increasing contradiction between man and nature, environmentalproblems have resulted in many problems, a serious threat to human survival. In recentyears, many problems arise in the environment are closely related to thegovernment. From these issues can be found, the legal system ofenvironmental responsebility to protect our government should assume is not perfect. Inorder to make government work better for Protect environment responsibility, establishand provisions on theresponsibility of government in environmental protection toimprove the relevant legal system, is currently China’s environmentalprotection legislation is a pressing matter of the moment.In this paper, from the perspective of administrative responsibility, mainlydiscussed the environmental protection responsibility our government shouldbear. Firstly, on the background of the problem is discussed, and the clear purpose of thestudy in this paper; introduces the domestic and foreignresearch situation about thisproblem and results, and the main research content and research method is explained indetail. Then this paper for"government environmental responsibility" is defined and thecontent in detail.The "responsibility","environmental responsibility" and "governmentenvironmental responsibility" are made analysis and discussion, so that thegovernment is the main body of environmental responsibility conclusion. The third partof the article is a series of laws and regulations on environmental protection in China’scurrent are analyzed, not perfect place to find out theenvironmental protection laws andregulations. For example: there is a legal"blank" in the field of ecological environmentprotection; lack of effectiveness of the existing law; government absence of legalprotection of the environmental right; environmental management andsupervision system is not perfect; because the implementation of environmentalprotection is not enoughis not in place and measures, which leads tothe environment for systems notharmonious, environmental infrastructure constructionserious lag; the environmental consciousness of the public generally low; technologypromotion system is not perfect and other reasons. Finally, the Chinese government environment legal liability further analysis, recommendations fromthe administrative system, legal revision and the establishment of specializedagencies and perfecting the government’s environmental responsibility system inchina. This paper provides a theoretical basis for improving the protection responsibilitysystem of our government environment by combining the relevant theory ofeconomics, environmental science. The combined use of these methods tomake the system more complete, and appropriate innovationproposed suits our countrynational condition approach.
