Research On Making Of Chinese Judge Evaluation System Perfective

Judge evaluation system is an important aspect of the court organization and personnel system.lt’s appraise and assay much more than the ability of judge trialling cases and the judge’s thought and morality。 It’s an impotant step for the court management,improving the quality of the judges and bounding the behavior of the judges.Establishing a practical and scientific evaluation,which is an important step for the judges professionalism and modernization to reform and improve the examination system of judges.But in a long time,depend on the justice practice, all kinds of court have its own judge evaluation institution,very disordered.Due to all round of reasons,Chinese current judge evaluation system continue to use the administrative evaluation system’s methods,choose the hero by mark,formism serious,assessment standard is not reasonablem,assessment organization lack neutrality,assessment methods and procedure is not consummate,and so on.All kinds of defects are kidnapping the ability of the judge’s independent judgement.The judge evaluation system has serious sick of endangering the justice independent,obstruct the justice fair.To improve and perfect the Chinese judge evaluation system is extremely urgent.In this paper, introducing the characteristic of justice work as a starting point,and follow on the summarize of judge assessment.By means of consulting and summing up the the material practical researching the judge’s inherent demand.The author summed up the characteristic and problem of Chinese current judge evaluation system. The author survey the practise of Judge evaluation system by using the methods of questionnaire survey and communicating with the judges, to probe the problems in the practise.Also the author reference the oversea’s experiences and the Chinese reform of Judges’sequence.Based on all this work,The author puts forward some advices for the judge evaluation system.The advices including five aspects:clearing the purpose of judge evaluation system,reforming the assessment organization,reduilding the assessment standerd,perfecting the assessment methods and procedure,using the assessment result.The author hopes to construct a judge evaluation system which match the discipline of justice work and the progress of judges professionalism.
