Study On Judge’s Check And Evaluation Institution

Judge’s check and evaluation is an important aspect of the court managementsystem. Although check and evaluation is used commonly in personnel managementas a kind of management method, but it is a sensitive question to the judges whoexercise national jurisdiction. In need of judicial administration or the improving ofjudicial quality, judge’s check and evaluation is existed in the western legal states. InChina, judges can not escape the destiny of being check an evaluated because of theinherent status of “public officials”. But, how can we improve judicial quality bychecking and evaluating judges normatively, and at the same time prevent the attackson judge’s independent jurisdiction? This question is worthy of studying. This articlestart with the basic theory of judge’s check and evaluation, get the Fujian high court’s<Comprehensive Evaluate Methods About Justice department and EnforcementDivision’s Staff(trial use)> as a sample, analyze the drawbacks of present judge’scheck and evaluation institution, and at last, support some suggestions to the reformof judge’s check and evaluation institution.In chapter one, we review the history of judge’s check and evaluation institution,describe the beginning and the development of judge’s check and evaluation in ourcountry.Chapter two is about the running situation of our judge’s check and evaluationinstitution. At first, introduce the legal basis of current judge’s check and evaluation.Secondly, analyze the running situation of our judge’s check and evaluation, concludethree forms of evaluation modes. At last, provide a brief introduction about thepractice of judge’s check and evaluation in Fujian province. In chapter three, we set aself-examination to the problems existed during the implementation of judge’s checkand evaluation from three aspects(organization, institution and index setting), conclude the drawbacks of present judge’s check and evaluation institution combinedwith the sample of Fujian high court’s <Comprehensive Evaluate Methods AboutJustice department and Enforcement Division’s Staff(trial use)>.In chapter three, we set a self-examination to the problems existed during theimplementation of judge’s check and evaluation from four aspects(organization,institution, standard and usage of results), conclude the drawbacks of present judge’scheck and evaluation institution combined with the sample of Fujian high court’s <Comprehensive Evaluate Methods About Justice department and EnforcementDivision’s Staff(trial use)>.In chapter four, we support some suggestions to develop judge’s check andevaluation institution of our country from six aspects(necessity, goal and prerequisite,building organization, setting standard, selecting mode, usage of results).
