With the speeding up of the pace of the construction of China’s rule of law, the supremacy of constitution concept of the rule of law has been paid more and more attention, supremacy of state and for the implementation of the judicial reform, especially on the court, procuratorate of the judicial system reform, to further promote the judicial personnel’s professional development and increase strength for the construction of modern rule of law.The judge performance appraisal system is the court system in order to detect the quality of the trial judge how developed, the judge performance appraisal system is a manifestation of the court judges to conduct a management measure, the national results of the work on the development of judicial officers, ethics literacy, trial skills, vocational skills and other aspects of the comprehensive test, assess whether the competent judge occupation regime. It is designed to pass evaluation of professional skills and professionalism of the judge’s assessment and supervision. The judge is required to improve self-development system.In practice, there is a performance appraisal system of judges issues appraisal system design is unreasonable, appraisal system implementation problems, the local jurisdiction of the courts is regulated and hampered local people’s congresses and local government agencies in personnel management, which seriously affected the judge independent status and independence of the judiciary trial. Causes Problems judge performance appraisal system is due to the Court’s personnel management system of the civil service management, leading to the trial judge’s job is limited by local authorities superiors. The judge performance appraisal system emphasis on "digital", the assessment indicators quantized in the assessment by numerical representation, although easy to operate, to a certain extent on the real objective evaluation of the trial capacity of judges, but excessive focus on "digital", "does not fully examine the the true level of the trial judge’s evaluation of the results of injustice not only dampened the enthusiasm of the judges, the judges also hinder the development of the profession, professional, elite road. Therefore, to further improve our judge performance appraisal system, we advise you to build an independent judiciary under reasonable and lawful judge the performance appraisal system, establish the basic ideas of the judges performance evaluation system, establish a strict standard procedures of examination, construction and ensuring the independence of judges as the core system, and ensure the safety of the post of judge, justice. Rational use of examination results, the training of judges to comply with the judge’s own characteristics, improve the operational capacity of judges, ethics, professionalism and improve their deficiencies. Judges and optimize team structure, the real "judge" in the trial left post, rational use of judicial resources, and promote the judges ordered forward to the profession, professional, elite direction.
