Living and dying is the natural rule for human development. Funeral andinterment industry has very close connection with each family and each person. Since2003, top ten profiteering industries were chosen through related public appraisal.Although it was often avoided by people, yet funeral service industry has entered "thelist" for many years. Due to this reason, it has been denounced by whole society. Withthe development of society and large scale tendency of funeral industry, the legalregulation of the funeral service industry is drawing more and more attention.However, the research on this issue is relatively not enough. This paper starts from thenature of funeral service industry, its history development, and obvious problems incurrent status, analyzing specific problems in administrative monopoly and marketregulators. And then the author proposes her own suggestions for anti-monopolyregulation and market supervision and coordination of funeral services in China. Thispaper is divided into three chapters:The first chapter is current status of funeral service industry and the existingproblems. Firstly, it describes the concept of the funeral service industry and thepublic nature of the industry. It is this special nature incompatible with “funeralprofiteering", so it is necessary to adopt legal regulation measures. Secondly, itelaborates the development history and current status of the funeral services marketand its legal system. The introduction of its background can help us to understand the current funeral industry management system, laying foundation for finding specificways to solve the problems in management status. Finally, based on the previousanalysis, it concludes that the main problems in funeral services market, which is alsothe focus of the study in later chapters.The second chapter discusses the administrative monopoly in funeral service.Firstly, it analyzes the type of monopoly in funeral services. Because there aredifferent points of view in this regard, clear monopoly type can let us act with awell-defined objective in mind. Secondly, it lists the administrative monopolyperformance in this industry. Again, it put forward with feasible suggestions for themanagement system of funeral industry, and government’s role in the basic funeralservices, as well as the anti-monopoly regulation. The author believes that the key ofadministrative monopoly regulation in funeral industry lay in the industrymanagement system reform and the transformation of the role of government. Inaddition, to enhance the implementation of the anti-monopoly law and industrylegislation is the best policy for the moment.Chapter three discusses market regulation for the funeral service industry. Firstly,it analyzes the necessity and social significance of strengthening market supervisionon funeral services, and explains the cognitive misunderstandings of simply taking“funeral profiteering” as a consequence of trade monopoly. It also clarifies theimportant role that market supervision plays. Analysis of the problems in the marketsupervision will be the focus of this chapter, which mainly includes market access andprice supervision. And learning from the experience of the United States and Japan, itputs forward relevant measures according to our national conditions. Finally,anti-administrative monopoly and strengthening market supervision and regulation areessentially important aspects in funeral service industry. From the perspective of therelationship of the two policies, power division of two regulations, the author giveshis own understanding about the coordination in the two regulations of the funeralindustry.
