| Human survival and development are closely related to food safety, and nowpeople pay more and more attention to food safety issues. In recent years, it has beeninevitable to make use of legal means to protect food safety because of frequent foodsafety accidents. In this paper, from the perspective of risk society, it puts forward thesuggestion of perfecting by analyzing the existing problems of food safety in ourcountry and the weakness of our criminal law relating to food safety crime.The article is mainly composed of four parts:The first part is the summary of food safety problems. First of all, it is the briefanalysis of the concept of food safety, food safety crime concept and nature, secondly itelaborates our country current food safety problems, and finally it analyses the necessityof the criminal law protection of food safety problem.The second part is about the risk society which is a view of food safety problems.Beck’s risk society theory are introduced briefly, and then come to a conclusion thatfood safety problem is a kind of baker’s modern risk. Then this paper analyzes the newfeatures which are showed by the food safety crime as the risk. In the end, it putsforward challenge and coping styles under the risk society theory to our countrycriminal law.The third part is about our country food safety crime criminal law status. It is abrief analysis about the regulation of food safety crime present situation in our countrypresent criminal law, including the criminal law system, setting of crime andpunishment the Settings of the defects and related content.The fourth part is about the thinking of the improvement of the food safety crimein our country criminal law. The author puts forward perfect opinions on food safetycrime of criminal law, and mainly includes the improvement of the criminal law system,increasing the part of the perfection of related charges, fine punishment andqualification punishment.In short, the importance of food safety is self-evident, so the criminal law as thelast line of defenses, social security, studies the effective way to protect the safety offood is significant. This not only can reduce and prevent the happening of crime but alsoensure the safety of human life and health. |
