Research On The Perfect Of Food Safety Supervision System In China

Food safety related to the people's health and life safety and health in relation to the economic development and social stability. In China, the nationwide food safety events frequently threatened people's health and life safety and the normal life order, and even damaged the image of the government and national. After entering into WTO, foreign trade in the green barriers for China's food export trade is increasingly obvious. In China, there are a series of laws and regulations, that is "Food safety Law of the People's Republic of China" carried out on June,2009, "Communicable Disease Prevention Act", "Product Quality Law" and Protection Act of the interests of Consumers" etc. All of above are constituted the legal system of food safety. However, there are still many defects that can't suitable for the society.The Food Code issued by the CAC has become the general standard and the WTO/SPS has become quarantine regulations of animals and plants among the developed and developing counties which are in favor of food safety supervision system.The law of food safety must be supplemented and completed with the development of the food safety problems.As the food origin disease and the epidemic outbreak and spread, developed countries strengthened the legislation of food safety supervision systems. The seamless supervision is applied in the overall process. However, in China, the seamless supervision had not come true. There are still many works have to do.In the EU and the USA, their food safety supervision institutions are independent and uniform. They are working in cooperation with a due division of labour. In this way, they can increase efficiency of food safety supervision. But it is opposite in China. Our country should gradually transform to the independent supervision mode and bring the government into full play in food safety supervision.Some relating legislation in our country is not perfect. There are many problems of the food safety standard system, quality safety inspection detection system and quality certification system. Such as operability is not strong, penalty is too weakly and so on. These conditions restrict the work of the food safety supervision. It's urgent to issuing many more standard which are according with the international convention.Although the risk warning and the information disclosure in our country had had a certain foundation, there are still some distances compared with the developed countries. In China the food safety risk warning and information disclosure system are not initiative and perspectiveness and they are not set up from the source. Things like that information release are not timely, information content lack and repetitive frequently happened.In the trace and recall and judicial relief field, there are also some gaps compared with the developed countries. After entering the WTO, our agriculture products have to restrict by the laws of importing countries. We must pay high attention to building the agriculture products traceable system. Because traceable system direct influences the recall system. There are no clear rules on the target and scope of the problem food recall. Subject of responsibility and supervision are not comprehensive. In the judicial relief, we can learn from the class action and punitive damage in the USA to strengthen judicial supervision.
