Research On The Legal System Of Food Risk Management In Risk Society

This paper, based on the theory of risk society, analyses the concept offood risk, the effective mode of food risk manarement and the currentlegal system of food risk management.In order to find the problems of thelegal system of food risk management: first, our country’s legal system offood risk management is lack of integrity and systematicness, the legalnorms of food risk management cannot form harmonious and unifiedwhole. Secondly, ignoring the characteristics of food risk uncertainty,potential, imbalance and diffusion of spillover effects, there are somedefects and deficiencies in the legal norms of food risk, which can not beeffectively inhibit food risk. Finally, because of the lack of effectiveremedy mechanism of rights,“food safety law” can not provide effectiveprotection,violated in the public food safety rights. Based on the risksociety perspective, we should change the traditional mode of legislationto elucidate the characteristics of food risk of our country, discuss theeffective mode of food risk management, perfect the legal system of foodrisk management measuers under the background of risk society andconstruct the new legal system of food risk management by the theory ofrisk society.
