On The Right Of Citizens’ Social Security

The citizens’ social security right put forward in order to correct the firstdistribution unfairness. With the development of national economy and people’s sociallife becoming more and more complicated, the citizens ’ social security right inpeople’s life plays a more and more important role. It is conducted through a secondallocation way to ensure the basic life of people.It plays an important role inpromoting social equity and maintaining social stability.Therefore, the research on therights of social security is becoming more and more important. This article based onforeign experience,according to our country,s problem in terms of social securityrights,puts forward the corresponding countermeasures. Along this basic idea, thisarticle is mainly to analyze five aspects on the citizens’ social security right.First of all, the first part mainly analyzes the connotation and legitimacy of socialsecurity right. The connotation analyzes from three aspects which is the definition, thecharacteristics and the content. Through the analysis, there is a further analysis on thefundamental charactics,equality,restrictive and the basic content of social securitybased on the elucidation of its basic meaning. In the social security right justification,there are mainly through the two aspects of positive and negative arguments.Thepositive aspect argument is from humanitarian and national obligations of citizens’social security rights and the negative argument is through the analysis of the survivalof the fittest and social security right conflicts.Secondly, the second part has an analysis on the social security concept chaging ofother countries.As a result of our country,s social security concept started relativelylate,so we are mainly to analyze social security concept chaging of western society. Itstransformation is mainly from the previous self-help social security concept at end ofthe nineteenth Century to the later extreme national security concept until thecombination of country,individual and society concept at nineteen seventies later.The third part mainly analyzes practice about the citizens’ right of social securitylegislation of overseas including international human rights convention and somecountries:the US,Britain, Germany and other countries. At the same time, there is anbrief analysis on the realizing mode of social security.The fourth part put forward some problems of our country on the citizens’ social security right legislation and implementation based on the researchment of the processof our country,s social security rights protection legislation.The fifth part put forwad three aspects measures to solve the problem on thelegistation and realizing of social security right and the measures contains theimprovement of social security legislation, perfecting social security rightsmechanism, improvement of social security right relief mechanism.
