Since the Middle Period of Tang Dynasty, the military men had been domineering, someof whom set up numerous separate regimes by force of arms in China.In troops, both generalsand soldiers disregarded the military law and discipline. They were arrogant and wild, withthe result that they often revolted their commanders and emperors. Therefore it presented achaotic political situation in Chinese history. In order to eliminate the military coup d’etatsand stabilize the political power, at the beginning of the creation of Northern Song,SongTai-zu set to reorganize the military affairs and enacted a new military system. In this paper,writing not only to the military legal system’s basic content shed, while also seeking the legalculture, including the military legal cultural background and specific legal system asembodied in the military legal cultural tradition.In addition to the introduction, conclusion is mainly divided into three parts. Theintroduction part is to research to make notes, this part mainly about the purpose, significance,research status, data collection and research methods were described, at the same time on theresearch object and background are introduced.Part of the text according to the Song Dynasty military law system’s basic content,characteristics and the traditional legal culture in order to start discussion. The first partdiscusses the basic content of the system of military law, including the military criminal lawsystem, military administrative system, the military judicial system three aspects. The secondpart mainly discusses the basic characteristics of the military legal system, mainly includingfour aspects characteristics. The third part is the combination of the Song Dynasty militarylegal system the legal cultural background to discuss the military legal system embodied intraditional legal culture, mainly from the revival of Confucianism and the concept of justiceand benefit the change of two respects to spread out an analysis.
