China’s mainland and the Taiwan Area belong to civil law, but there are many differences in terms of criminal identification legislation. This article is intended to sort out the legislative specification of criminal identification of the Taiwan Area, and compare the cross-strait status of criminal identification legislation from the identification and identification procedures. At the same time, there have been stronger related between Mainland China and Taiwan, and a large number of cross-border criminal activities. As the rising number of interaction-related cases accepted by the cross-strait courts, the issues dealing with the mutual assistance in criminal between the two sides have also been proposed. Considering the status quo of cross-straits relating to different systems of the politics and legislation, the author try to star from the small field of criminal identification, and then propose to build a mechanism of the cross-stait mutual assistance in criminal identification, based on sorting out the legislative specification and comparing the differencese. The author intends to seek a new way for establishing the mutual assistance in criminal. And in the framewor of the cross-stait mutual assistance in criminal identification, to make some feasible reform proposals by learning the Taiwan’s effective experience. With a view to favore for promoting to build the mutual assistance mechanisms, and reform of criminal identification system in the Mainland.The innovation is proposing to build a mechanism of the cross-stait mutual assistance in criminal identification on the basis of the Judicial Identification. It intends to open up a new path for Judicial Identification of cross-stait Judicial Activities. And then to seek a new breakthrough for comprehensive assistance in the future.It is contributing to the steady development of cross-stait relationship and establish the unification of China.
