Research On Some Problems Of Judicial Assistance Across Taiwan Strait

With the increasing exchanges in trade between main land and Taiwan people across Taiwan strait, the rate of crime is increasing significantly, which impede the peaceful development across Taiwan strait. Therefore it is urgent to strengthen cooperation in administration of justice and jointly fight against crime. The cooperation in administration of justice across Taiwan strait is a special matter owing to the modern history of China.It is also a matter of national internal affair across different regions. On April4th,2009,’The agreement to fight crime together and judicial mutual across the Taiwan strait’was signed at the meeting between Cheng and jiang which held in Nanjing and organized by association for Relations Across the Taiwan Strait and association of strait exchange.In my paper, On the basis of analysis on the cooperation in administration of justice across Taiwan strait. I go further research in the limitations of the "agreement" in the text and the problems of’agreement" will meet in the implementation. My paper will go further on the problems of mutual cross-border organized crime, cross-border drug crimes, judicial documents and cross-strait judicial investigation of evidence and evidence adoption system, the Taiwan straits of the recognition and implementation civil and commercial award.
