A Study On Civil Legal Relationship Of Organ Donation

Organ donation is the basis of transplant surgery, which is the most effective means of treatment in organ failure and plays an important positive role in clinical. Chinese organ transplantation technology is advanced in the world, yet we has low surgery proportion. The development of organ transplantation is blocked, and the biggest reason is lack of organ donation. To increase the number of the for donation organs, to create the atmosphere of willing to donation, it’s necessary to build a good donation system. There is a great possibility that China Human Organ Transplant Ordinance will be built this year. It’s claimed to complete the donation system, to promote the development of career of organ transplantation. It’s time to study the civil legal relationship of organ donation, and it also has realistic meaning for Chinese organ transplant legal system.This article introduces the concept and defines the scope of the organ donation. This thesis is divided into five parts, analyzing the elements of the organ transplant within subject, object and content concept. It summarizes the characteristics of the organ transplant law relationship. Finally, it points out that Chinese organ donation system has many defects and loopholes. In order to advance the development of organ transplants, we should improve the national wide organ transplant system and legal system construction.
