The Existing Problems In Rual Dispute Mediation Mechanism In Coastal Areas And Countermeasures

People Mediation, is an activity that relies on people’s own strength to solve disputes and a legal system with Chinese characteristics. It gains the reputation of "Oriental Experience". It has made great contributions on solving conflicts,enforcing national unity, maintaining social stability and so on. However,with the rapid development of society, People Mediation has been declining cause its inelasticity with the society; its fall in Multiple Dispute Settlement Mechanism and its gradually weakening fuction.This paper,based on the author’s work city’s implementation of People Mediation, analyzes its current operating mechanism,its present situation,its existed problems and messures to perfect the multipartite mechanism system. In light of the concept of mechanism, people’s machanism and the multipartite mechanism system, this paper learns the development of madiation system at abroad and home to offer the theoretical and pratical foundation in order to the deeper perfection of the people’s mediation of Ruian.With the comnination with the current situation of Ruian’s Mediation System, this paper uses bands of disparate date to explain Ruian’s operating mechanism of People Mediation, the organized net, personal structure, the methods of operation,the working situation and the current work. These bands of disparate date prove the fall of People Mediation in the local mechanism system and deeply analysze the restricted factors in the development of people’s mediatism. There exist six major factors which reduce the bottleneck of Ruian’s People Mediation. Here are the sie factors. The unstable mediating team results in the elder madiator. The low quality of the team restricts the development of the people’s mediation. The insufficient funds bring about mediators’lack of motivation. The scant publicity leads to the disability of People Mediation. The erroes in judgement give rise to the insufficient training course and inadequate guidance. People Mediation, judicial mediation and administrative mediation are lack of effective communication. Last, this paper emphasizes the way of reconstruction of Mediation System. In order to get a long-term development,Mediation System should follow five steps to highlights its dominance in efficiency,lowcost:improving the regulanization of mediating troops and the quality of the mediators; reclaiming functions of commission of inquiry at all levels to explore construction of the full-time mediating troops; strengthening publicity to rebuild the deserved position of People Mediation System; increasing funds of People Mediation to improve mediators’treatment; achieving the combination and interation of People Mediation judicial mediation and administrative mediation.
