On The Problem Of Refugees In The Perspective Of International Law

As we all know, after the World War One, the conception of refugees went intothe field of international law and the rules，principles and systems of refugeeprotection come into being. In recent years, as the gap between developing countriesand developed countries has become larger and larger, and the situation of somecountries and district rises and falls, the international society faces more complexsituations. The1951“Convention on the Status of Refugees” and the1967“RefugeesProtocol”,as cornerstone of refugee law in the protection of the rights of refugees,have also appeared insufficient. Considering that，from the aspect of internationalrefugee law and based on refugee rights protection theories，the thesis makes aresearch on such protection’s development and relevant stipulations, analysesexisting problems under the international refugee law, suggests methods to improvethem. The article has three parts.Part one: the general review of refugeeThis part has four aspect, it mainly overviews something related to the partbehind. Firstly, it tells the definition and the excluded items. Then the thesis analysesthe classification of refugee. According to the reason, refugees have political ones,war ones, economical ones and environmental ones. On the third, it tellsinternational law papers, include basic human protect document, internationalconvention about refugees, other convention about refugees and the resolution ofthe United Nations. At last, on the organizations to protect the rights of refugee，UNHCR is very important.Part two: problems of refugee laws and systems on the aspect of internationallawThis part think about relevant international laws and practice, point out theproblems of refugee laws and systems on the aspect of international law. This parthas three aspects. Firstly, the international convention has problems. Then,organizations that protect refugees have problems. At last, countries that acceptrefugees have their problems. We cant forget that situation is changing. We have new questions. Terrorism is very horrible.Part three: find a way to solve the problemsAccording to the problems, we have the suggestions. Firstly, internationalconventions and internal laws should improve themselves. Then, UNHCR shouldimprove its functions. At last, we should have a cooperation on this problem.
