Trademark Right Protection Under The Network Environment

Network as a new industrial revolution, changing the people’s economic activities andbusiness behavior patterns, characteristics of the network has also made the traditionaltrademark law applicable challenged. Under the network environment, the new forms oftrademark infringement, trademark legal system lags inherent in existing legislation, areexamples of trademark protection in China under the network environment needs to beimproved. This paper starts from the traditional trademark protection system, briefly combedthe basic legal issues of trademark protection under network environment, under thecircumstances of the network trademark infringement characteristics and form of expression,expounds the present situation of legal protection of the trademark right in our country, putsforward the concept of perfecting our trademark protection mechanism, to provide strongprotection under the network environment to the trademark fair competition, construction ofsocialist market economy, promote social prosperity and development.This paper is divided into four parts. The first part is an overview of the protection oftrademark rights under the environment of network, expounds the network environment oftrademark, trademark infringement concept features. The second part introduces the types andfeatures of trademark infringement under the network environment. Various types oftrademark infringement under the network environment variety, the different types of tortliability and penalties are different. The third part is the analysis of trademark infringers,recognition, including the tort liability and the way to bear tort liability. The fourth part putsforward advice to improve the protection of trademark right in China under the networkenvironment.
