Females are playing a irreplaceable part in market economy as an important force for the developing harmonious society,however the females suffer the Employment Sexism Legal,and the phenomenon is getting worse. Although our government has issued a series of laws to Avoid women being discriminated a, but it is still cannot reach the legislation effect in the employment market.It is not only infringes labor rights and other related rights,but also goes against the constitutional principle that every citizen is equal under the law and legal provisions. It is a strong theoretical and practical significance to depth discussion and study of sex discrimination in employment.Part one mainly describes the relevant theories of the sexism in employment.It includes defining the concept of sexism employment discriminating and its classification.Part two mainly probes into the legal regulation of the sexism in employment about the international organization and western countries and Japan. Their law has been already quite completed, which has important reference value to Chinese.Part three mainly describes the situation and laws against employment sex-discrimination in our country.There is no specialized legislation and institution of anti-sex-discrimination in Employment Law in China.It’s no legal definition of employment sex discrimination, so is the burden of proof, the system of oversight is imperfect, the punishment is not enough,fostering sex discrimination in employment. And those imperfect means of relief for women workers rights have been infringed, even if they consider themselves to be discriminated in employment, but also unable to protect their own rights.Part four describes recommendations of the legal regulation of sex discrimination in employment for China.First,we should improve the anti-employment discrimination legislation,make the meaning of employment sex discrimination and the burden of proof clean, increase employer illegal corresponding legal responsibility. Improve the maternity insurance system, the implementation of a flexible retirement age system. It is necessary to set up specialized legislation and institution of anti-sex-discrimination and improve judicial relief,and gradually establish anti-discrimination in employment law and control system in China.
