Study On Issues Of Economic Law In Construction Of Smart City

The construction of smart city is based on a comprehensive application of information technology, it is a turning point after the world economic crisis. Smart city plays a decisive role in promoting economic recovery and prosperity. At present, the countries all over the world pay a high degree of attention to the construction of smart city. China also hopes to catch this opportunity of development, not only to solve the problems of urbanization, but also the construction of smart city means a lot to the social and public interests. China’s construction of smart city is also at an early stage, standing on the point of view of economic law, to provide legal and institutional support for the achievement of smart city from the national macro-plan regulation, the improve of the industrial and technological policies as well as national and personal information security is of great significance to the new life, new industrial development and new community management of smart city which is based on the mass of information and intelligent filtering process, and to the promotion of economic and social harmonious and healthy developmentThe main purpose of this thesis is to analyze the experiences of foreign smart cities’ construction, put forward the main problems of smart city construction in China, and analyze from two aspects of economic law——macro-control and the market regulation, on intelligence industry policy and smart city’s construction plan, the information industry policy, as well as the market regulation of the industry of the Internet of Things and protection of the information security, including public and private information, propose economic law countermeasures to provide support for the development of the Internet of Things industry and smart city’s construction.The main research methods are:by using the literature analysis methods, I explained specific meaning of "smart" and "city" within the smart city, introduced the technical basis and objective facts on which the concept of smart city was proposed, and I studied the foreign countries’smart cities’ construction plans, implementation of the policies and laws related to the development of industry of Internet of Things, technical papers and other documents to summarize the experiences of economic law from which we can learn; through a comparative analysis method, I gave a summary of the current situation of construction of smart city in China, and put forward what the problems were in the construction of the smart city; as well as the methods of systems analysis, according to the system of economic law to find deep-seated problems of economic law which was causing the problem, based on the point of view of macro-regulation and market regulation, to analyze the specific problems and causes, and in the end to give the corresponding countermeasures of economic law; by using classification analysis methods and the method of interests structure analysis of economic law, according to the three major structure constituting the Internet of Things, I analyzed and gave a prediction of the market position, market prospects of the three main players of the Internet of Things industry, and according to the practical needs of the different stakeholders, combined with the fact that the Internet of Things industry was still at its early stage of development, I gave a suggestion to what adjustments should be made by the market regulation law in this case to help the enterprises to establish their standards to protect product quality, as well as how to protect the personal information in consumer protection Law. This thesis is mainly divided into four parts except the introduction and the conclusion:The first part is an overview of the smart city. First, it gives the specific meaning of "smart" and "city" to explain the meaning of the smart city,only to answer the problem of what is the smart city; second, it discussed the the technical basis and objective reality requires on which the smart city concept was proposed and the foundation of smart city’s realization.The second part introduces the construction plans, support policies on industry of Internet of Things and the realization of intelligent of special departments and practical cases of smart cities construction of foreign countries, sums up the experiences from the point of view of economic law.The third part analyzes the construction status and the problems of China’s construction of smart city, and analyzes the problems and causes of market regulation and macro control which is reflected on different issues.The fourth part gives the corresponding economic law countermeasures or legislative proposals, to provide a reference for the economic and legal system for the construction of smart city.All in all, through a brief analysis of the foreign smart city’s construction and the Internet of Things industry development policies and legislation, focusing on the economic law issues and causes shown during the smart city construction process, to analysis and take specific economic law measures to promote the development of the smart city and the Internet of Things industry in China has a certain theoretical and practical significance.
