The generation of the Magna Carta signed in1215is not only the achievement of conflict among the secular aristocrats, hurches, autonomous cities and kingship, but also the achievement of the constitutionalism fighting in the England since12th century. Thereafter whenever the English liberty and rights was threatened by the expansion of the monarchy, the Englishmen would be traced back to the Magna Carta which created the tradition of liberaty and fighted back. The Magna Carta had been confirmed, quoted as saying, argument and explanation, which had been the refuge of liberal spirit in England.The paper can be divided into three major parts:the foreword, the text, and the conclution. The foreword briefly introduces the brief reasons and the significance for the choice of this topic, the present situation of the academic research in and abroad, the research objectives and methords, as well as the innovation of this paper. The text is made up of three chaters:I Mainly discuss relations of the king among the secular aristocrats, churches and city in the first part, which makes the historical background of the emergence of Magna Carta. The second mainly probes the main content of the Magna Carta which is to protect and confirm the liberty and right of secular aristocrats, churches and city right, and it discuss the principle of the compromise of the separation of powers, due process of law, the king under law, the supremacy of law had been polished. The third aims at analyzing the historical influence of Magna Carta. Especially the impact on the modern British constitutionalism. The conclusion summarizes the historical significance of the Magna Carta, further deeping the understanding of English liberal tradition.
