With the development of network technology, the dependence of network is becoming stronger and stronger for all walks of life, but crimes that use network present the tendency of expansion. Internet crime has become one of the important issues of common concern in modern society. The internet theft crime is the most common and has the highest crime rate. New problems and contradictions continue to produce which causes the legislation lag more prominent. Traditional theft theory is not enough to solve the problems, such as identification, incrimination and penalties, resulting the criminal regulation of networks theft crime inefficiency in practice. It’s unnecessary to say the network theft crime with the seriousness and huge dangers. This paper studies the crime of theft in the literature about the network, combined with the theory of criminal law and judicial practice, focusing on the analysis of two aspects. First, start from the concept of cybercrime and analysis the characteristics of network theft crime from the subject of a crime, the object of a crime, crime objects and the other aspects, providing the basis for the identification of network theft crime. The criminal regulation of several types of network theft crime is varying perspectives of academia. Based on the analysis of the theory, put forward my own views in this paper. Especially theft of virtual property behavior qualitative issues has been debated in academia, this paper, based on the concept of virtual property; virtual property attributes to define, on the basis of analyze the theft of virtual property, proposed theft of virtual property should be given theft and the specific application of law. In addition, in view of the particularity and complexity of network theft crime, its jurisdiction, the amount identified and the other problems also need further study.
