With the advent of the Internet age,the network and people's lives are inseparable,network crime also showed multiple trends.In the case of cybercrime,the crime of property type occupies the vast majority,and in the case of property crime,the phenomenon of theft of virtual property is worthy of attention.As a new form of property,although they only exist in the network space,but due to the huge market demand,virtual property transactions increasingly prosperous.However,due to the lack of legislation,theft of network virtual property behavior is rampant,such thefts need to be resolved.This paper is divided into four parts.The first part first defines the virtual property of the network,and demonstrates the property attribute of the network virtual property from the concept,characteristics and legal attribute of the network virtual property,and argues the legal interests of them.The second part analyzes the current situation of the virtual property of the network,and analyzes the principle of dealing with the virtual property from the legislative and judicial aspects.At the legislative level,China's theft of the virtual property behavior and no specific provisions,only scattered in a variety of laws.At the level of judicial operation,the behavior of theft is not consistent,and the phenomenon of different cases is endless.Through the legislation and judicial practice of two aspects of the analysis,summed up the current characteristics of the rules for the management of virtual property.The third part summarizes the reasons for the different ways of dealing with the theft,and argues that the virtual property of the network is reasonable.The fourth part puts forward the feasible solutions and opinions of legislation and judicature in view of the shortcomings of China's theft of virtual property behavior.
