Fair use system is also called free-usage system, which means that under certain Conditions people can use other’s copyright freely without he consent of the owner and do not have to pay for it. The core value of intellectual property law is to facilitating the communication and development of Literature-art and science-technology. Similarly, as a part of intellectual property law, the copyright system whose core values are to encourage the creation and dissemination of Literary and Artistic works. Currently, the Communication-Network is under the condition of constantly updated and rapid development, and in such network environment some unprecedented challenges has been brought to the traditional copyright legal system.One of the purposes of the copyright legal system is the benefit balance between the creators, users and disseminators, and according to this balance the development of culture, arts and sciences has been realized.The purpose of this paper is to explore through the network transmission environment and reasonable use system are faced with the problem, in draw lessons from foreign experience in related regulations and on the basis of through argumentation, and theoretically put forward the ideas and improve the system of fair use of copyright in China.This article is divided into four parts.The first part focuses on overview of copyright fair use system, including the meaning, nature and origin. The second part focuses on the network environment the copyright fair use system brings challenge and impact. The third part focuses on the foreign legislation of copyright fair use system under the network environment, in order to bring our references. The fourth part mainly is aims at our country under the network environment the copyright fair use system of perfect Suggestions are put forward.
