The right of education is the basic human right for the citizens. Equal rights in education are rights that the constitution endows the citizens as well as the prerequisites and basis for them to participate in other social activities. For children of rural migrant workers who are in weak position, it is a significant method to change this situation. This paper is divided into three sections: Introduction, text and conclusion. Text is divided into three chapters:The first chapter is the basic theory of equal rights in education for the children of rural migrant workers. This chapter is divided into two parts:the first part is the basic definition of the equal rights in education, which demonstrates the concept of equal rights in education and analyzes the main contents and features of the equal rights in education. The second part is an overview of the equal rights for rural migrant workers’children in education, which defines the stage of education of rural migrant workers and their children, and elaborates the connotation of equal rights in education for the children of rural migrant workers.The second chapter is the current situation and problems of the rights to be educated for the children of rural migrant workers. This chapter is divided into three parts, the first part is the detailed description of the current status of education for the children of rural migrant workers; the second part is to analyze the reasons for the unfair education received by the children of rural migrant workers; the third section illustrates the protections and deficiencies of the laws in this country in the equal rights of education for the children of rural migrant workers.The third chapter is the suggestions to improve the situation of the equal rights in education for rural migrant children. The suggestions are proposed from three points of views, of which the first chapter suggests to improve the rules of "Law of Compulsory Education" and repeal the relevant discriminatory provisions from the angle to perfect the relevant laws and regulations. The second chapter is about to advance the supporting system, such as:the reform of the household registration system and the improvement of the management system of compulsory education. Chapter three presents the ways to perfect judicial guarantees and put forward suggestions for relief from the points of views of constitutional law, administrative law and civil law respectively.
