The administrative entrustment is of a commonly used administrative method,administrative chief subject entrusts its own administrative functions and powers tothe authorized body. Through this process, the chief subject gains increased efficiencyand reduced cost. However, as the scope continues to broaden, more complex issuesfollowed as a result. To highlight the acute problems, the implement of internal legalresponsibility within the commissioned body is very important. According to therelevant provisions of the "Administrative Procedure Law of the State CompensationLaw and the Administrative Licensing Law, the commissioned only has limited legalaccountability provisions It only functions on behalf of the subject. In the meantime,the entrusting administrative subject retains its right to recovery while reserving thelegal liability. But the law does not have specific norms or proceedings between thesubject and the commissioned body on recovery. This caused legal accountabilityentanglement the subject and the body. When bearing the legal responsibility, bothparties turn to stay out of line. Then prevarication phenomenon often occurs.Therefore, administrative liability has its crucial position in the field ofadministrative laws. To pursue and hold the liability of the subject is a necessary wayto urge them to exercise their powers better, and ensure the correct implementation ofthe legal responsibility for safeguarding the basic requirements of the national publicinterest. While the liability by entrusting administrative body is in a very complex andimperfect state, I believe that a more in-depth analysis of the problem will help theperfection of administrative entrustment system.
