With the appearing of the new crime cases involving underworld-typeorganizations, force trading has become a common ways for underworld-typeorganizations. At present, he crime organization involved the sinister gang who wereshielded by their external forms of "legal" companies, have committed many seriouscrimes to make profit through taking forced trading. This ways make the violencebecome hidden and the trading become legalization form, especially in engineeringbidding, auction, asset transfer items acquisitions field, which has destroyed the socialeconomy and politic life order seriously. Because the charges amendment wasmodified, forced trading charges behavior has been effectively expand, which cateredto the needs of social development. This article is mainly about the further analysis onthe definition and characters of the force trading to understand the relationshipbetween the means behavior and purpose behavior. The means behavior of the crimeof coercing transactions includes violent behavior and menace behavior is no disputein theory. but violence shall be limited to the extent of the minor injuries, t he objectof violence in the implementation of the person of limited category, and the extent ofthe threat is enough to make the victim from fear; and it only refers to legaltransactions in purpose behavior, when other transactions can’t be comprise, such asDrug trade and Smuggling. Through the Systematic analysis of the crime of coercingtransactions on the five types, the article from the scope of the targets of behavior, todetermine the scope of the crime, which further analysis method from the form andthe behavior of the features. Through each behavior’s analysis, can compare thedifferences between other crime. These conclusions will play a role at the crime ofcoercing transactions in judicial practice.
