The police’s power of interrogation and examination is an important executive powerof the police to maintain the social order. Whether it is applicable or not is directly relatedto the protection of the citizens’ fundamental rights and social security. In order to protectthe citizen’s free right and respect the human right in maximum limits, we must controlthe police’s power of interrogation and examination and eradicate the abuse of the powercompletely to ensure the police to be strict, fair and to offer civilized law enforcement.Besides, it is the requirement of safeguarding the police’s legal authority, improving therelationships between the police and the public, promoting the harmony of the police andthe public, safeguarding the police’s legal rights, and establishing the good image of thepublic security organs.Studying the application of the police’s power of interrogation and examination,establishing the institutional system of preventing the abuse of the power and ensuring thepolice to exercise the power legally is a very important task for police’s law field andprofessional field.Besides, the study on the police’s power of interrogation and examination, whichinvolves the human rights protection, immediate enforcement and the exercise of thediscretion, has a good theoretical research and practical value.The paper is divided into three sections: the first part is a summary of the police’spower of interrogation and examination. It is elaborates from the basic concepts, the legalnatures and the legal features. The second part is enumerating the problems and theircauses of the police’s power of interrogation and examination through analyzing thepractical cases. The third part is putting forward some solutions to maintain the socialorder and protect the human rights from improving the legal norms, specifying theprocedure of interrogation and examination and adding the legal remedies.
