A Study On The Legal Norms Of The Police's Handling Of Obstructed Behavior

As an important police law enforcement activity of the public security police,interrogation and examination plays an irreplaceable role in maintaining the public security order of our country and preventing and stopping crimes.It is also one of the main means for the police to perform their duties in the world.Almost all theories and theories recognize the positive social benefits of inventory inspection.Safe and smooth completion of the inventory is the ideal state for the police to enforce the law,but due to the influence of various factors in the actual operation,the inventory will inevitably encounter the obstruction of the relative party of law enforcement,resulting in the inventory can not be carried out smoothly,how to properly and efficiently deal with all kinds of cases that obstruct the inventory is an urgent problem to be solved.From light to heavy,the degree of obstruction to the enforcement of interrogation can be divided into three levels,namely verbal abuse,physical(unarmed)resistance and tool resistance.The people's police should also use law enforcement language,police tactics and tactics and police force to respond to and deal with obstructions of different degrees.The main means of dealing with obstruction is the use of force by the police,that is,unarmed restraint and the use of police weapons.But the treatment is based on the people's police regulations on the use of police instruments and weapons,"at the scene of the public security organs of the people's police to stop illegal and criminal behavior operation regulation,the use of guns by the public security organs of the people's police wearing specification",the public security organs of the people's police are interrogating code and other laws and regulations there are some unscientific and unreasonable place,cannot effectively guides the work of police practice.The author has been working in the police patrol line for a long time,and has accumulated some practical experience in inventory inspection.The content of each successful disposal means is given to the legal background,legal connotation and legal consequences.Therefore,when encountering obstacles in actual law enforcement,every word and every action of the police is the response of the law.This paper not only discusses and analyzes the disposal strategies and measures to hinder the conduct of interrogation under different circumstances,but also puts forward three Suggestions to improve the legislative level of the relevant laws and regulations on the use of police force,stipulate the corresponding level of force according to the degree of resistance of the law-enforcing object,and increase the obligatory provisions of the counterparty of interrogation.
