Study On Legal Control Of Administrative Entrustment

In western countries, Administrative entrustment is one of the key subjects in the studyof administrative law, it has become an important part of public administration. In ourcountry, with the development of social economy in recent years, in order to completethe task better, to improve administrative management efficiency, public powerentrusted scope is expanding, organizations or individuals authorized to exercise publicpower has become even more popular, each institution of law has problems in theprocess of implementation, administrative entrustment is not exceptional. Our countrylegal system is not unified legislation of it at present, although it has involved in otherlaws and regulations, but also has no specific procedure, lacking correspondingsupervision. Legal control is weak and the practice of administrative entrustment isincreasingly common. It isn’t fit now. Therefore, this article is not only elaborated thebasic theory of administrative entrustment, but also elaborated how to strengthen thelegal control, then summed up the issues in legal control of administrative entrustment,improve and perfect it, in order to promote comprehensively advancing the rule of law,to speed up the construction of the socialism country of law.The first part of this thesis mainly introduces the basic theory of the legal control ofadministrative entrustment, it separately carried on in-depth analysis of the concept ofadministrative entrustment and legal control, summarized the connotation ofadministrative entrust legal control, discussed the theoretical basis at the same time: theadministrative decentralization theory, governance theory and supervision theory.The second part introduces problems of legal control of administrative entrustment, thispart first carries on the analysis about the present situation of administrative entrustlegal control, summarized the problems existing in the legal control of administrativeentrustment, mainly including the following three aspects: too general fuzzy inlegislation; too freely in law enforcement; lacking of legal supervision.The third part introduces how to improve legal control of administrative entrustment.combined with the problems, mainly including the following three aspects: Inlegislation, perfecting the administrative entrustment and basic principles of laws; InLaw enforcement process, Clear delegate objects, put an end to illegal entrustedphenomenon, entrust program legitimation; at the same time, strengthen the supervisionof entrustment.
