Research On Legislation Issues Of Social Association In China

Nearly three decades, the social associations has gradually grown and developed to the third branch of important force in addition to the government and enterprise in the international community. The rise of social associations is of great significance to the development of society. Social associations can effectively make up for the shortcomings and deficiencies of the government administration; overcome the drawbacks that are lack of the market economy system, alleviate social conflict and resolve social contradictions. The right of association is one of the basic political rights of citizens under the Constitution. After the reform and opening up, the awareness of citizens to freedom of association is gradually awakening, the demand for freedom of association is increasing, a large number of social organizations are emerging. Although the social associations’ legislation has certain achievements, and established a basic legal framework, there are still many shortcomings and gaps, which make social associations, can not play its due role. In this paper, by comparative study, theoretical analysis, empirical analysis and other research methods, analysised the necessity and feasibility of the legislation of the social groups, pointed the social groups legislative theory is based on the theory of civil society and freedom of association theory. On the basis of legislation in foreign visits and scholarly analysis, summed up the extraterritorial countries experience as well as legislation on China’s social organizations revelation that China should develop legislation of the Basic Law of the social groups, and the formation of a high-level, full social groups Legislation system; reduce the threshold established by social organizations and social organizations tax relief. From the point of view of building a socialist country ruled by law, social groups important part of the legislation is to improve the socialist legal system, social organizations formed organized groups of power, which on the one hand to strengthen the protection of the rights of individual citizens, on the other hand has also become the constraints of power balance of power. Certainly in the form of legal status of social groups, to regulate the behavior of social groups, can lay the foundation for building a socialist country ruled by law. Legislative issues for the community should be in legislation guiding ideology, should not be no limit of one-sided support of the citizens right to freedom of association, but should seek a balance between state power and the citizens right to freedom of association, the right to freedom of association both can be exercised, but will not affect the social life and public order.
