Study On The Protection Problem Of Labor Rights And Interests Of Farm Workers In Hainan

Hainan state farms have played an important role in Hainan’s economic development and social stability. Farming cultivate worker, as the main force in construction dedicate their all wisdom to farming cultivate career. Since the founding of Hainan land reclamation, through the high accumulation of the development of the rubber, hot industries, Farming cultivate workers have made great sacrifices to Hainan in the economic, social and public utilities, establish the largest natural rubber production base in the country, however, farming cultivate workers’labor rights has been ignored for a long time. Therefore, it has great historical and practical significance to protect labor rights and interests of Hainan farming cultivate workers. Especially in recent years, as Hainan state farms is delegated to the Hainan local government, it speeds up its process of separation from the society and politics, farming cultivate system reform is deepening, the deep-seated contradictions emerged gradually during the transition period, particularly, what more obvious is workers labor rights. We should give high priority to workers land contractual management rights, social security and employment rights, income distribution rights and so on, which is violated seriously.The article is divided into four parts. The first part introduces the history and development process of Hainan land reclamation and the workers, describes the various stages of development of Hainan state farms and workers structure, emphasizes the important contribution to the development of agriculture from these workers, and demonstrates the significance of strengthening the protection of the rights and interests of farm workers. The second part mainly elaborates the labor rights and legal provisions of farming cultivate worker, analyzes the particularity of labor rights protection between the land reclamation and non adhesive rubber workers, the difference of labor rights and interests among farming cultivate workers, peasant and industry workers, and the importance of land for farming and non adhesive rubber workers. The third part mainly puts forward the problems of labor rights and interests between rubber workers and non rubber workers, discusses and analysis the related causes of the farm workers’ contracted management right, collective labor contract, salary and employment rights, social security rights and so on. The fourth part discusses the protection measures of farm workers labor rights. Through the analysis the importance of labor rights and interests of farming cultivate worker from the front parts, according to the current problems from farmer workers, this article puts forward feasibility suggestions. Hoping this can play a better role to promote the protection of the farm workers labor rights, and build a harmonious and stable labor relation of farming cultivate worker eventually.
