Inrecent years, pyramid sales activities are increasingly rampant. Large numbers ofinvolved people and money have made serious damage to normal life and economicorder. According to statistics, in2011, the national industrial and commercialauthorities investigated and dealt with a total of1419cases of pyramid sales,destroyed18,800dens, educated and repatriated175,000people.Until February28,2009, The Amendment of Criminal Law of the People’s Republic of China (7th) waspassed by the NPC Standing Committee, The Crime of Direct Sales Organizationand Leadership Activities was added into the criminal law. The penalty system ofpyramid selling crime has been improved.May19,2012, the Xiamen Haicang District People’s Procuratorate cracked thelargest pyramid case in the history of Fujian, involved more than1600people. Icome from Fujian, this case causes my strong interest in the in-depth study aboutpyramid sales crime.This paper embarks from the criminal law theory and the research achievementsof predecessors, combined with today’s pyramid selling criminal judicial practice, tomake a preliminary discussion for t The Crime of Direct Sales Organization and Leadership Activities, for making some auxo-actions to perfect the theory andpractice works of this crime.
