Since the reform and opening up, China’s economy is undergoing rapid, stableand sustained development with more and more foreign capital flowing in. Amongthem, the real estate market is a hot spot of foreign investment in China by virtue ofits huge development potential, high profits and good fluidity. The entry of foreigncapital improves the overall level of China’s real estate industry and promotes thedomestic real estate enterprises integrating with international standards and market.On the other hand, it also pushes up the prices of houses and contributes to theformation of the real estate market bubble. Therefore, research on the market accesssystem of foreign investment in real estate of China is of great theoretical andpractical significance.This article, with the methods of combination of theoretical and empiricalanalysis, qualitative and quantitative analysis, inductive and deductive analysis, is toresearch the market access system of foreign investment in real estate on the basis ofcurrent laws and regulations in connection with foreign investment and real estatemarket, and is divided into the following four chapters:The first chapter is an overview of the basic situation of China’s foreigninvestment in the real estate industry. Within this chapter, analysis of the reasonsthat foreign capital flows into China’s real estate market comes first. And then it isthe introduction of the current situation of foreign investment in China’s real estate market from the perspective of main forms and major regions. In the end, there is ananalysis of the positive impact and negative impact of foreign investors in China’s realestate market.The second chapter focuses on market access system of foreign investment inreal estate of China. It begins with an overview of the legislation on the entry offoreign capital in the real estate market, including the related laws, judicialinterpretations, administrative regulations, ministerial regulations, local regulations.Then it comes to the dissection of investing entity and regulatory body in the marketaccess system of foreign investment in real estate of China. Finally, there is adetailed analysis of the special conditions for foreign investment in the real estatemarket of China from both substantial and procedural view, including investmentforms, registered capital/total investment, investment methods, investment returns,investment scope, investment procedures and other requirements.The third chapter is an analysis of the legislation of the access system in foreignreal estate market and the revelation therefrom. First of all, it is a brief introductionof the current laws and regulations regarding the entry of foreign real estate market,taking examples of the major countries of American continent, European continentand Asian continent. On the basis of this, it goes to further summary of theexperiences to improve the market access system of foreign investment in real estateof China in view of investing entity, regulatory body and access conditions.The fourth chapter presents suggestions to improve the market access system offoreign investment in real estate of China. The starting point is an analysis in depthof the existing problems in the market access system of foreign investment in realestate of China concerning the provisions in laws and regulations and review andapproval procedures. With regard to these shortcomings and deficiencies, somepractical suggestions are to be put forward for the improvement of the system, mainlycovering the aspects of legal framework, approval and supervision, industrial policies,tax measures, financial system, and foreign exchange mechanism.
