With the development of the market economy goes to greater depth, the degree of China's active or passive foreign investment continues to depth. Because of the great potential of China's real estate market, and in order to get huge profits, a lot of foreign capital through various methods swarm into the real estate market.In recent years, with the foreign capital continuous swarm into the real estate market, China had also published a series of laws, regulations and rules, which in order to regulate the foreign capital swarm into the real estate market. All of these want to making the foreign investment enter the real estate have laws to abide by. However, most of the rules and regulations are published singly or jointly by the different departments of State Council in their own functions and powers' scopes, so they are a little disorder. Therefore, it is necessary to make the legal research of the access system for foreign of the real estate market. Their key points are the researches on the basic theory and the analysis of rules and regulations.This article uses the literature analysis, comparative analysis, historical analysis, logical analysis, induction and deduction, and other methods. And it combines economic law, jurisprudence and other departments of law to study the subject of the access system for foreign of the real estate market. This article is start with laws and regulations and rules, then compare with the legislative status of China longitudinally, and compare with the foreign legislations and practices crossly, in order to find out the shortcomings and deficiencies. By describing the concepts, and analyzing the market subjects and the forms which access to the markets, to make my own views and evaluations. Through the variety of laws, regulations and departmental rules and regulations the collation and combination, described the entry of foreign investment in the real estate market means that laws, regulations and departmental rules which should be suited. Through the analysis and researches, I will give suggestion which aim at the improvement of various deficiencies.This paper is divided into the following parts:the basic theory of access system for foreign real estate market, the other countries' legislative access system for foreign real estate market, the variety of subjects of China's access system for foreign real estate market, the analysis of access conditions and modes, the suggestion of how to perfected the access system for foreign real estate market.
